RELEASE OF LIABILITY WAIVER:

In consideration for participating in an event or overnight stay (collectively “Stay”), on behalf of myself and my next of kin, heirs and representatives, I release from all liability and promise not to sue Mind & Body Complete Wellness LLC/DBA Retreat Ranch and their employees, officers, directors, volunteers and agents (collectively “MBC”) from any and all claims, including claims of MBC’s negligence, resulting in any physical or psychological injury (including paralysis and death), illness, damages, or economic or emotional loss I may suffer because of my participation in a Stay on Retreat Ranch, including travel to, from and during the Program.
I am voluntarily participating in a Stay on Retreat Ranch. I am aware of the risks associated with traveling to/from and participating in this Stay, which include but are not limited to physical or psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability (including paralysis), economic or emotional loss, and/or death. I understand that these injuries or outcomes may arise from my own or other’s actions, inaction, or negligence; conditions related to my participation and travel; or the condition of the Stay location(s). Nonetheless, I assume all related risks, both known or unknown to me, of my participation in this Stay, including travel to, from and during the Stay.
I agree to hold MBC harmless from any and all claims, including attorney’s fees or damage to my personal property, that may occur as a result of my participation in this Stay, including travel to, from and during the Stay. If MBC incurs any of these types of expenses, I agree to reimburse MBC. If I need medical treatment, I agree to be financially responsible for any costs incurred as a result of such treatment. I am aware and understand that I should carry my own health insurance.
ASSUMPTION OF THE RISK AND WAIVER OF LIABILITY RELATING TO CORONAVIRUS/COVID-19:
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person to person contact. As a result, federal, state, and local governments and federal and state health agencies have put in place specific recommendations of which you can access via the CDC or World Health Organizations websites.
MBC has put in place some preventative measures to reduce the spread of COVID-19; however, MBC cannot guarantee that you will not become infected with COVID-19. Further, visiting and/or staying with MBC/Retreat Ranch could increase your risk of contracting COVID-19.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that I may be exposed to or infected by COVID-19 by visiting MBC/Retreat Ranch and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected with COVID-19 at a Stay with MBC/Retreat Ranch may result from the actions, omissions, or negligence of myself and others, including, but not limited to, MBC employees, contractor employees, work exchange team members, owners and clients and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I may experience or incur in connection with staying with MBC/Retreat Ranch.
On my behalf, I hereby release, covenant not to sue, discharge, and hold harmless MBC, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of MBC, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Stay.
CODE OF CONDUCT:
I, herein the Guest, understand and agree that I will not:
- Harass, harm, threaten, discriminate, libel, defame, or otherwise shame and/or injure “MBC”, its owners, officers, employees, instructors, contractors, assigns, affiliates, agents, successors, and all other Guests. If such occurs, one may be asked to leave with no refund.
- Purposefully destroy, damage or cause harm to any item, animal, person during my Stay
Guest understands and agrees that MBC and its affiliates have the right to immediately expel, without refund or transfer of any kind, a Guest who breaks, or is suspicious of breaking, any section or amount of this Code of Conduct.
SEPTIC SYSTEM:
I, herein the Guest, understand that only provided toilet paper can be flushed in the toilets (no feminine products, wipes, etc). Any guest who flushes other items in the toilet may be subject to septic repair fees.
CAMERAS ON SITE:
I, herein the Guest, understand that there are cameras in all common areas and walking paths and that footage may be recorded.
AGREEMENT:
I, herein stated as the Guest, have read the above Terms & Conditions and fully understand its content. I am legally able to sign and voluntarily agree to and accept all text stated above in the MBC TERMS & CONDITIONS and understand they apply to any minors and other members traveling and staying in my group and/or with me.
